Welcome to 87Website, a web design and digital growth service provided by Martel Growth Partners Inc. (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of our products, services, and website.

By purchasing or using any of our services, you agree to be legally bound by these Terms

1. Service Overview

87Website offers three primary service tiers:

Essential: 1-page website with CRM, mobile optimization, hosting, and monthly check-ins.

Accelerate: Multi-page website with funnel, CRM expansion, AI tools, blog integration, payment systems, and more.

Utopia: Full-scale digital automation with unlimited websites, WhatsApp marketing, 24/7 AI reception, and more.

All plans include onboarding, setup support, and customer service as described in each plan’s deliverables.


2. Payment & Billing

Billing Frequency: All subscriptions are billed monthly or annually based on your selection.

Automatic Renewal: Subscriptions auto-renew unless canceled in writing at least 7 days before renewal.

Late or Failed Payments: Access to services may be paused if payment fails after 3 attempts.

No Refunds: Due to the nature of digital delivery, all sales are final. Refunds are not provided once onboarding begins or deliverables have started.

Upgrades & Downgrades: Clients may upgrade plans at any time. Downgrades are only applied after the current billing cycle.


3. Delivery Timelines

Essential websites are built within 3 business days from when all required onboarding details are received.

Accelerate and Utopia builds typically take 7–14 business days, depending on project complexity.

Timeline starts after all onboarding forms, assets (logos, brand info), and domain access are received.

Delays in form completion, domain setup, or third-party account access (e.g., Google Analytics) may push timelines.


4. Client Responsibilities

You agree to:

Complete onboarding forms truthfully and promptly.

Provide timely access to necessary accounts and assets.

Communicate professionally and respond to revision requests within 3 business days.

Acknowledge that changes outside the agreed scope may incur additional charges.


5. Scope of Work

Each plan includes defined deliverables. Custom requests outside the scope (e.g., advanced coding, logo design, legal copywriting, e-commerce beyond stated limits) may require:

Deliverables are listed clearly before purchase. It is the client’s responsibility to review what is included prior to payment.


6. Revisions Policy

Essential Plan: 1 round of revisions within 7 days of delivery.

Accelerate Plan: 2 rounds of revisions within 14 days.

Utopia Plan: 3 rounds of revisions within 21 days.

Revisions must be submitted in writing. Further revisions may be quoted at our hourly rate or as a custom add-on.


7. Intellectual Property

You retain ownership of your logo, brand assets, and uploaded content.

We retain the right to use design work for portfolio or marketing unless requested otherwise.

Custom-built sites and systems are licensed to you as part of your subscription. You do not own the backend platform infrastructure (e.g., GHL).


8. Hosting & Platform Access

We provide secure hosting through trusted third-party providers.

Access to editing features may vary by plan.

Deletion or modification of backend system code or files outside the admin portal is prohibited.


9. Service Cancellation

You may cancel at any time by emailing [email protected].

Upon cancellation:

You may request a data export (available for up to 30 days after cancellation).

Access to your CRM, emails, automations, and website will be revoked at the end of your billing cycle.

Custom domains will be transferred if requested (within 7 business days).

No partial refunds are given for unused time.


10. Third-Party Tools & Integrations

We are not liable for issues resulting from third-party platforms, such as:

Google Analytics

Stripe

Facebook

WhatsApp

GoHighLevel

While we provide integration support, platform outages or changes are outside our control.


11. Data & Privacy Compliance

All client data is handled in accordance with our Privacy Policy. We comply with A2P, CAN-SPAM, and GDPR laws. Clients agree not to misuse data or use our platform to send unauthorized communications.


12. Dispute Resolution

If a dispute arises:

If unresolved, both parties agree to mediation prior to legal action.

Legal jurisdiction will be the Province of Ontario, Canada.


13. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for lost profits, business interruption, or indirect damages.

Maximum liability shall not exceed the total amount paid by you in the past 90 days.


14. Changes to Terms

We may update these Terms at any time. Clients will be notified via email or dashboard. Continued use after changes constitutes agreement.
